Secret courts in the Uk are seizing the assets of thousands of elderly people. The court hears about 23,000 cases a year IN PRIVATE, involving people unable to take their own decisions. So far civil servants from the Office of the Public Guardian have taken ?23M in fees alone directly from the bank accounts of those struck down by mental illness such as dementia.

To avoid this you must have `living Will` or lasting power of attorney. Without this relatives must apply to the courts (and its costly) to manage assets or your health and welfare.

I am not 100% sure if this applies to partners who have assets in joint names but could cause issues if a partner has separate bank accounts etc. Your last Will and testament will of course override this on death.

The courts have so far taken control ?3.2 billion of assets. Officials are legally required to act where people do not have a `living Will`or `lasting power of attorney` which would hand control over to family or friends. The officials failed to consult with relatives, imposed huge fees and even raided homes searching for documents.
